FanPet Terms of Service

About these terms

These terms are a contract between you and Fancify LLC ("we", "us"), the maker of FanPet. By installing or using FanPet, you agree to them. If you use FanPet for a business, you agree on behalf of that business.

Our Privacy Policy explains how we handle personal data. It is part of these terms.

The service

FanPet is a Shopify app. It lets merchants show sign-up popups in their store, collect emails and phone numbers from visitors, give rewards like discount codes, and see results.

• You must have an active Shopify store and be at least 18 years old.
• You use FanPet through your Shopify account. Keep your login safe; you are responsible for what happens under it.
• We may add, change or remove features. During early access, some features may be unfinished or change often.

Fees

FanPet is free during early access. If we start charging, we will show the price in the app before you are billed. All charges go through Shopify Billing and appear on your Shopify invoice.

• Shopify's billing and refund rules apply to those charges.
• You can cancel at any time by uninstalling the app. Fees already paid are not refunded, unless the law or Shopify requires it.

Your responsibilities

You decide what your popups say and whose data you collect. That means you are responsible for:

• Consent and marketing laws. Getting valid consent before you send marketing emails or texts, and following laws such as CAN-SPAM, TCPA, GDPR, CASL and CCPA where they apply.
• Your own privacy notice. Telling your store visitors how you use their data, including that you use FanPet.
• Rewards. Honoring the discounts and offers your popups promise. You set the terms; we only deliver the code.
• Your content. The text, images and offers you add must be yours to use and must be truthful.
• Visitor requests. Handling data requests from your visitors. We help through Shopify's privacy tools, as our Privacy Policy describes.

Acceptable use

You may not use FanPet to:

• Collect data without consent, or buy, sell or rent email or phone lists.
• Show content that is illegal, misleading, hateful or adult.
• Run fake giveaways or offers you do not plan to honor.
• Break Shopify's terms or the law.
• Copy, resell or reverse engineer FanPet, or try to get around its limits or security.
• Overload or attack our systems.

We may pause or remove a popup, or suspend your access, if you break these rules. We will tell you why, unless the law or safety stops us.

Data and ownership

Your data. You own your store data and the data your visitors give through your popups. You let us use it only to run FanPet for you. For visitor data, you are the controller and we are your processor. We do not sell it.

Our product. We own FanPet, including its code, templates and design. You get a limited, non-transferable right to use it while you have it installed. Feedback you send us may be used to improve FanPet, with no duty to you.

Third-party services. FanPet runs on Shopify and other providers named in our Privacy Policy. Their terms apply to your use of them, and we are not responsible for their outages or changes.

Disclaimers and liability

No guarantees. FanPet is provided "as is" and "as available". We do not promise it will be error-free, always online, or bring a certain number of sign-ups or sales.

Limit of liability. To the extent the law allows, we are not liable for indirect or lost-profit damages, or for lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing.

Indemnity. You will cover our costs if a claim against us comes from your content, your offers, your marketing messages, or your breaking these terms or the law.

Ending, changes and contact

Ending. You can stop at any time by uninstalling FanPet. We may end or suspend your access if you break these terms, or stop offering FanPet with 30 days' notice. After you uninstall, we delete your data as our Privacy Policy describes.

Changes. We will update the date at the top when these terms change. For big changes, we will tell you in the app first. If you keep using FanPet after a change, you accept the new terms.

Governing law. These terms are governed by the laws of the State of Montana, USA. Disputes go to the courts there.
